In the new regulation, the legislature refers to the so-called electronic revocation function and will regulate it in the future in Section 356a of the German Civil Code (BGB). The function is similar to the one already prescribed Cancel button to see. Contracts that can be concluded online must also be able to be terminated online and revoked in the future.
This is all of them Distance selling contracts affected. The new function must meet the following criteria:
- easy to find
- clearly visible
- be constantly available throughout the entire cancellation period
In addition, providers are not allowed to create any additional hurdles, such as requiring additional registration or app downloads. In practice, revocation takes place in two steps:
- Cancel contract with a button
- Summary information is displayed and revocation must be confirmed
Consumers must be given the opportunity to clearly state which contract or part of the contract they want to cancel. After revocation, providers must quickly send confirmation of receipt, for example by email. There must also be an electronic cancellation function for contracts via third-party platforms.
